Chapter 1 General Provisions
Article 1 To standardize the procedures of vocational skill appraisal work and ensure the quality of vocational skill appraisal, these rules are formulated in accordance with the "Regulations on Vocational Skill Appraisal."
Article 2 These rules apply to institutions and personnel engaged in vocational skill appraisal work.
Article 3 The Vocational Skill Appraisal Center of the Ministry of Labor is responsible for guiding the nationwide organization and implementation of these rules.
The Vocational Skill Appraisal Guidance Centers affiliated with the labor administrative departments of provinces, autonomous regions, and municipalities directly under the Central Government (hereinafter referred to as provincial vocational skill appraisal guidance centers) are responsible for the organization and implementation of these rules within their administrative regions.
The Vocational Skill Appraisal Guidance Centers affiliated with the industry competent departments of the State Council (hereinafter referred to as industry vocational skill appraisal guidance centers) are responsible for the organization and implementation of these rules within their respective industries.
Article 4 The implementation of these rules is subject to supervision and inspection by the Ministry of Labor, provincial labor administrative departments, and the wage institutions of the industry competent departments of the State Council. Chapter 2 Vocational Skill Appraisal Institutes (Stations)
Article 5 Vocational Skill Appraisal Institutes (Stations) are places approved by the labor administrative departments to carry out skill appraisal, undertake various business tasks specified in the "Regulations on Vocational Skill Appraisal," and are responsible for consulting services and information statistics related to vocational skill appraisal.
Article 6 The qualification requirements for general trade vocational skill appraisal institutes (stations) are formulated by experts organized by the Vocational Skill Appraisal Center of the Ministry of Labor and promulgated after approval by the Ministry of Labor. The qualification requirements for industry-specific vocational skill appraisal stations are formulated by experts organized by the industry vocational skill appraisal guidance centers, submitted to the Ministry of Labor for approval, and promulgated thereafter.
Article 7 The vocational skill appraisal guidance centers, entrusted by the labor administrative departments, are responsible for the qualification review of units applying to establish vocational skill appraisal institutes (stations). The review content includes:
(1) Reviewing the feasibility of establishing institutes (stations) according to the requirements of overall planning, reasonable layout, and selection of optimal locations, combined with industrial structure, labor market demand, and vocational skill appraisal work planning;
(2) Reviewing the qualifications of the appraisal institutes (stations) applying to undertake appraisal trades according to the basic requirements for appraisal institutes (stations) proposed in the "Regulations on Vocational Skill Appraisal," and determining the work, levels, and categories they are allowed to undertake.
Article 8 To establish general trade vocational skill appraisal institutes (stations), opinions of the industry competent departments should be solicited, and after review by the vocational skill appraisal guidance centers according to the regulations of the Ministry of Labor and provincial labor administrative departments, approval should be obtained from the labor administrative departments; to establish industry-specific vocational skill appraisal stations, opinions of the provincial labor administrative departments where they are located should be solicited, reviewed by the industry vocational skill appraisal guidance centers, approved by the wage institutions of the industry competent departments of the State Council, and approved by the Ministry of Labor. When necessary, vocational skill appraisal guidance centers at or above the provincial level shall review the vocational skill appraisal institutes (stations).
Article 9 Vocational skill appraisal institutes (stations) implement an annual inspection system. The annual inspection work should be organized and implemented by the vocational skill appraisal guidance centers affiliated with the provincial labor administrative departments or the wage institutions of the industry competent departments of the State Council according to the unified requirements of the Ministry of Labor.
The main contents of the annual inspection include: the implementation of the annual work plan for vocational skill appraisal, whether the venue, equipment, testing methods, personnel, etc. meet the standards, the implementation of rules and regulations, and feedback from various aspects on the appraisal work. The results of the annual inspection shall be approved and announced by the provincial labor administrative departments or the wage institutions of the industry competent departments of the State Council.
Chapter 3 Vocational Skill Appraisal Evaluators
Article 10 Vocational skill appraisal evaluators are personnel who conduct evaluation and review of vocational skill appraisal subjects within the prescribed trades, levels, and categories according to unified standards and norms.
Article 11 Evaluators are divided into two levels: evaluators and senior evaluators. Evaluators can undertake appraisal of primary, intermediate, and advanced technical levels; senior evaluators can undertake appraisal of primary, intermediate, and advanced technical levels as well as technician and senior technician qualifications.
Article 12 The qualifications for evaluators are:
(1) Evaluators must have qualifications of senior worker, technician, or intermediate professional technical position or above; senior evaluators must have qualifications of senior technician or senior professional technical position.
(2) Evaluators should master the necessary theories, techniques, and methods of vocational skill appraisal and be familiar with relevant laws, regulations, and policies on vocational skill appraisal.
(3) Evaluators should abide by the code of conduct for vocational skill appraisal evaluators and relevant rules and regulations.
Article 13 Evaluators are subject to qualification assessment and certification systems. The assessment of evaluators is organized by provincial or industry vocational skill appraisal guidance centers under the guidance of the Vocational Skill Appraisal Center of the Ministry of Labor.
Qualification certificates for evaluators of general trades are issued by provincial labor administrative departments. Qualification certificates for evaluators of industry-specific trades are issued by the Ministry of Labor.
The Vocational Skill Appraisal Center of the Ministry of Labor is responsible for organizing the formulation of assessment outlines for evaluators and senior evaluators, compiling training materials, and providing assessment question services.
Article 14 The appointment and use of evaluators are coordinated by provincial or industry vocational skill appraisal guidance centers and must meet the following requirements:
(1) Evaluators must be appointed from personnel with qualifications, and their responsibilities, rights, and interests should be clarified through appointment contracts.
(2) Evaluators should be dispatched in a non-fixed rotation manner to form evaluation teams. Each evaluation team shall have one team leader who is fully responsible for the team's work and makes final decisions on disputed technical issues. The team leader should have certain organizational and management abilities and more than one year of experience in vocational skill appraisal work.
(3) Evaluators should not consecutively engage in evaluation work at the same vocational skill appraisal institute (station) more than three times; at least one-third of the evaluation team members should be rotated each time.
Article 15 Vocational skill appraisal guidance centers at all levels should establish evaluator files and annual assessment systems. The term of office for evaluators is three years. Upon expiration, the vocational skill appraisal guidance center shall submit a comprehensive evaluation report to the department issuing the evaluator qualification certificates for review and decide on reappointment. Chapter 4 Vocational Skill Appraisal Test Questions
Article 16 Vocational skill appraisal implements unified question setting. Appraisal test questions must be compiled based on the "Technical Level Standards," "Vocational Skill Standards," "Standard Skill Appraisal Specifications," and the unified requirements and methods of the Ministry of Labor.
The question bank for general trade skill appraisal is organized and compiled by the Vocational Skill Appraisal Center of the Ministry of Labor and promulgated after approval by the Ministry of Labor.
The question bank for industry-specific skill appraisal is organized and compiled by the industry vocational skill appraisal guidance centers, technically reviewed and approved by the Vocational Skill Appraisal Center of the Ministry of Labor, and jointly promulgated by the industry competent departments of the State Council and the Ministry of Labor.
Article 17 After the occupational skill appraisal question bank is promulgated and implemented, all test questions for occupational skill appraisal shall be drawn from the question bank. For trades that have not yet established and promulgated an occupational skill appraisal question bank, the provincial or industry occupational skill appraisal guidance center may organize the compilation of test questions, which, after approval by the provincial labor administrative department or the labor and wage institution of the State Council's industry competent department, can be used locally and reported to the Ministry of Labor's Occupational Skill Appraisal Center for record.
Article 18 The dispatch of occupational skill appraisal test papers shall be carried out in accordance with the unified requirements and methods of the Ministry of Labor.
Test papers provided by the occupational skill appraisal question bank shall be sent in a confidential manner as clean copies. The main contents sent include: test papers, standard answers, scoring criteria, and lists of equipment, tools, and materials required for operational skill appraisal.
The printing of test papers is the responsibility of the provincial or industry occupational skill appraisal guidance center, which shall select the printing factory (site) according to national regulations on printing and copying secret carriers, and assign special personnel to supervise the printing.
All stages of test paper handling must strictly implement a graded management responsibility system according to confidentiality regulations and be supervised by the test paper compilation department. In case of any leakage, it must be reported immediately to higher authorities and corresponding remedial measures taken.
Chapter 5 Management of Occupational Skill Appraisal Examination Affairs
Article 19 Occupational skill appraisal implements a regular appraisal system. The provincial or industry occupational skill appraisal guidance center is responsible for formulating appraisal work plans and arranging the release of appraisal announcements.
Appraisal announcements can only be issued after approval by the provincial labor administrative department or the labor and wage institution of the State Council's industry competent department. The announcement should include the name, category, and level of the trade being appraised, the time and place of the professional technical knowledge and operational skill assessment, as well as basic registration conditions.
Article 20 Personnel who meet the application conditions shall complete the registration procedures according to prescribed procedures. The occupational skill appraisal institute (station) is responsible for reviewing the applicant's qualifications, and after approval by the local occupational skill appraisal guidance center, the institute (station) issues the admission ticket.
Article 21 The occupational skill appraisal institute (station) is responsible for managing the examination venue and organizing invigilation, with personnel from the local occupational skill appraisal guidance center conducting inspections.
Article 22 Invigilators must abide by the occupational skill appraisal invigilator code of conduct, maintain examination order, and fill in examination records.
Article 23 Assessment personnel should be equipped according to the requirements of occupational skill appraisal standards. The assessment team must establish strict work procedures for grading, clarify the responsibilities of assessment personnel at each stage, and sign to take responsibility.
Article 24 Assessment results are recorded and filled in by the summary scorer. Both the assessment team leader and the summary scorer must sign or stamp the results registration form to take responsibility.
Article 25 After each appraisal, the occupational skill appraisal institute (station) shall fill out the statistical report form uniformly formulated by the Ministry of Labor and submit it to the local occupational skill appraisal guidance center.
The provincial or industry occupational skill appraisal guidance center shall summarize the occupational skill appraisal statistical reports and submit them to the Ministry of Labor every six months.
Article 26 The remuneration standards for assessment personnel are formulated by the provincial labor administrative department or the labor and wage institution of the State Council's industry competent department.
Article 27 Appraisals should generally be conducted within the occupational skill appraisal institute (station). If it is necessary to conduct appraisals outside the institute (station), an application must be submitted to the occupational skill appraisal guidance center, which will verify the appraisal site, equipment, and other conditions provided. Appraisal can only proceed after confirmation that standards are met.
Chapter 6 Certificates
Article 28 For personnel who pass the occupational skill appraisal, a national occupational qualification certificate shall be issued. The certificate processing procedure is as follows:
The occupational skill appraisal institute (station) for general trades shall submit the list of qualified personnel to the corresponding occupational skill appraisal guidance center for review and summary, which is then approved by the labor administrative department. Certificates are uniformly processed by the occupational skill appraisal guidance center according to the Ministry of Labor's prescribed format and coding scheme, and issued after verification and stamping by the labor administrative department. The occupational skill appraisal institute (station) is responsible for delivering the certificate to the individual.
The occupational skill appraisal station for industry-specific trades shall submit the list of qualified personnel to the industry occupational skill appraisal guidance center for review and summary, which is then approved by the labor and wage institution of the State Council's industry competent department. Certificates are issued after verification and stamping by the industry competent department's labor and wage institution. The occupational skill appraisal station is responsible for delivering the certificate to the individual.
The occupational skill appraisal station for industry-specific trades must submit the list of certificate holders to the local labor administrative department for record.
Article 29 The Ministry of Labor's Occupational Skill Appraisal Center is responsible for formulating the certificate filling format and coding scheme. Provincial and industry occupational skill appraisal guidance centers compile unified codes for general trades and industry-specific trades certificates in their regions according to the scheme.
Article 30 Certificate verification stamping:
(1) The appraisal and assessment institution shall stamp the seal of the provincial level or above (including provincial authorized delegated prefecture or city) or the industry occupational skill appraisal guidance center;
(2) The issuing authority shall stamp the special seal for skill appraisal of the provincial level or above (including provincial authorized delegated prefecture or city) labor administrative department or the labor and wage institution of the State Council's industry competent department;
(3) The special embossed seal for skill appraisal of the provincial level or above (including provincial authorized delegated prefecture or city) labor administrative department or the labor and wage institution of the State Council's industry competent department shall be stamped at the lower corner of the certificate photo.
Article 31 The single-item passing scores for professional technical knowledge and operational skill assessments are valid for two years.
Chapter 7 Supplementary Provisions
Article 32 Labor administrative departments of provinces, autonomous regions, municipalities directly under the central government, and the State Council's industry competent departments may formulate implementation rules based on these regulations, combined with local and industry realities. Occupational Skill Appraisal Assessors Code of Conduct: 1. Strive to study relevant laws, regulations, and documents, diligently research professional knowledge, and continuously improve policy and appraisal levels.
2. When performing appraisal tasks, assessors must wear assessor badges.
3. Earnestly perform assessor duties, strictly implement appraisal assessment regulations and examination rules.
4. During appraisal tasks, assessors must not leave their posts without authorization. If unable to continue work due to illness or other reasons, they may leave only with the consent of the person in charge and after being replaced.
5. Be fair and honest, maintain integrity, uphold principles, judge impartially, strictly evaluate scores according to standards, and truthfully fill in appraisal results and assessment records.
6. If relatives or students taught by the assessor participate in the appraisal, the assessor should voluntarily recuse themselves.
7. Strictly keep test questions and evaluation secrets confidential.
8. Consciously accept supervision and inspection by the labor administrative department and the vocational skill appraisal center.
