Notice from the Ministry of Civil Affairs and the Ministry of Finance on Cancelling the Filing of Social Organization Membership Fee Standards

Civil Affairs Departments (Bureaus) and Finance Departments (Bureaus) of all provinces, autonomous regions, and municipalities directly under the Central Government, Civil Affairs Bureaus and Finance Bureaus of all planned single-listed cities, Civil Affairs Bureau and Finance Bureau of Xinjiang Production and Construction Corps:
To effectively transform government functions, streamline administration and delegate power, promote the lawful autonomy of social organizations, and stimulate the vitality of social organizations, the following notice is issued regarding matters related to social organization membership fees:
1. From the date of issuance of this notice, the membership fee standards approved by social organizations shall no longer be submitted to the competent business units, social organization registration management authorities, and financial departments for record.
2. Social organizations approved by the social organization registration management authority may collect membership fees from individual members and unit members.
3. Social organizations may reasonably formulate membership fee standards based on factors such as the scope of business stipulated in the articles of association and work costs.
The amount of the membership fee standard shall be clear and shall not be floating.
4. When social organizations formulate or modify membership fee standards, they shall hold a members' meeting or members' representative meeting, with attendance of more than two-thirds of the members or members' representatives, and be approved by more than half of the attending members or members' representatives by secret ballot. No other forms shall be used to formulate or modify membership fee standards except for the members' meeting or members' representative meeting.
5. Social organizations shall disclose the resolution on the membership fee standards to all members within 30 days from the date of passing the resolution.
6. Social organization membership fees shall be mainly used for providing services to members and expenditures related to various business activities carried out in accordance with the purpose of the social organization.
Social organizations shall disclose the income and expenditure of membership fees to members annually, regularly accept the review of the members' meeting or members' representative meeting, and report the income and expenditure of membership fees during the annual inspection of the social organization.
7. When social organizations collect membership fees, they shall use the social organization membership fee receipts printed (supervised) by the Ministry of Finance and the finance departments of provinces (autonomous regions, municipalities). Other income besides membership fees shall not use social organization membership fee receipts.
8. If the formulation, modification, collection, use, and management of social organization membership fees do not comply with the provisions of this notice, the social organization registration management authority may impose corresponding penalties in accordance with the relevant provisions of the "Regulations on the Registration and Administration of Social Organizations."
The social organization registration management authority and financial departments shall supervise and inspect the income and expenditure of social organization membership fees and handle any problems found in a timely manner.
9. If the collection of membership fees by social organizations does not comply with Articles 3, 4, and 6 of this notice, social organization members have the right to refuse to pay and may report to relevant departments.
The "Notice of the Ministry of Civil Affairs and the Ministry of Finance on Adjusting the Policy on Social Organization Membership Fees and Other Related Issues" (Min Fa [2003] No. 95) and the "Notice of the Ministry of Civil Affairs and the Ministry of Finance on Further Clarifying the Policy on Social Organization Membership Fees" (Min Fa [2006] No. 123) are hereby repealed simultaneously from the date of issuance of this notice.
