Measures for Resolving Consumer Disputes in Shanghai's Laundry Industry
1. To protect the legitimate rights and interests of consumers, regulate the business conduct of the laundry industry, and fairly and reasonably resolve consumer disputes in the laundry industry, these measures are formulated in accordance with the Consumer Rights Protection Law of the People's Republic of China, combined with relevant local laws, regulations, and the actual situation of the laundry industry.2. All operators engaged in the laundry industry shall comply with relevant national laws, regulations, and these measures.
3. Operators shall hang their business licenses in a prominent place in the store and clearly display service items, charging standards, complaint phone numbers, etc., to accept consumer supervision.
4. When accepting clothes or items from consumers for cleaning, operators shall declare in advance any defects such as damage, discoloration, moth holes, missing buttons, etc., as well as any consequences caused by processing, and note them on the receipt. If any defects are missed during inspection, the original condition of the clothes must be maintained, and the consumer must be contacted within two days; otherwise, the operator shall bear the legal consequences. Consumers should inspect the quality of the processed clothes on the spot when collecting them. If any quality issues are found due to missed inspection, consumers may keep the original receipt and raise the issue with the operator within two days; otherwise, it will be invalid.
5. The washing method used by the operator must be agreed upon by the consumer in advance and noted on the receipt.
6. For severe wear on collars, cuffs, crotch, hips, etc., if the clothes tear after washing and ironing, compensation is generally not provided; operators may offer free repairs.
7. Operators shall note stains on clothes on the receipt. For stains remaining after washing that were not noted on the receipt in advance, 50% of the laundry fee shall be refunded.
8. For quality issues of the fabric or garment itself, or shrinkage, thread loss, fading, color transfer, mismatched colors, or bubbling of bonded interlinings caused by incorrect washing labels, operators shall provide proof to assist consumers in claiming compensation from the seller.
9. If consumers do not pick up their laundry on time, a daily storage fee of 0.5 yuan per item will be charged after 30 days. Operators have the right to dispose of items stored for more than six months; if operators delay returning items, they shall compensate consumers 0.5 yuan per item per day.
10. Dry cleaning shops without dry cleaning equipment, using counterfeit or inferior equipment, or passing off water washing as dry cleaning shall compensate twice the laundry fee. In case of washing accidents, compensation shall be based on the original price of the clothes.
11. Consumers with high-end, branded, or valuable clothes worth over 1000 yuan may agree in writing with operators to use special fine cleaning services. The fine cleaning fee shall not exceed 55% of the consumer's quoted price. Clothes without such an agreement shall be treated as ordinary laundry.
12. Operators shall be responsible for compensation for damage, loss, or other accidents caused by poor management or careless operation. Specific compensation methods are as follows:
1. For partial defects that do not affect normal wear, operators shall focus on repairs and compensate up to 10 times the laundry fee.
2. For lost, damaged, or unusable clothes (except leather cleaning), compensation shall be up to 20 times the laundry fee. The compensated clothes shall belong to the operator.
3. For fine cleaned high-end or valuable clothes that still have wear value, compensation shall be 30% of the insured value after repair. For clothes that lose wear value, full compensation of the insured value shall be given.
4. Suits shall generally be calculated by piece, with a 6:4 ratio between jacket and pants.
13. For disputes difficult to identify during washing services, consumers and operators may agree to send the items to relevant departments for appraisal. The appraisal fee shall be advanced by the operator, with the consumer providing an equal amount as a guarantee. The final responsibility shall be borne by the liable party.
14. If consumers and operators have disputes requiring compensation, they may negotiate directly or through the laundry industry association, or complain to the consumer association or appeal to the industrial and commercial administration department, or directly file a lawsuit with the people's court. Arbitration may also be applied for with the Shanghai Arbitration Commission according to the arbitration agreement between both parties.
15. These measures shall come into effect from the date of issuance.
