The "Beijing Laundry and Dyeing Industry Operation Management Specification" (Interim) has been approved by the Beijing Municipal Bureau of Commerce, Beijing Municipal Administration for Industry and Commerce, Beijing Municipal Bureau of Quality and Technical Supervision, Beijing Municipal Environmental Protection Bureau, Beijing Municipal Water Affairs Bureau, Beijing Municipal Health Bureau, Beijing Municipal Work Safety Supervision Bureau, and Beijing Municipal Urban Management Comprehensive Administrative Law Enforcement Bureau, and jointly issued for implementation.
Chapter 1 General Provisions
Article 1 To strengthen the management of the city's laundry and dyeing industry, regulate market order and enterprise operations, protect the legitimate rights and interests of operators and consumers, and promote the orderly development of the laundry and dyeing industry, these specifications are formulated in accordance with the "Consumer Rights Protection Law of the People's Republic of China", the "Occupational Disease Prevention Law of the People's Republic of China" and its supporting management measures, the national industry standard "Professional Conditions and Technical Requirements for Opening Laundry and Dyeing Businesses", Beijing local standards "Service Operation Procedures for Opening Laundry and Dyeing Businesses", "Beijing Implementation Measures for the Water Law of the People's Republic of China", "Beijing Water Pollutant Discharge Standards", "Beijing Implementation Measures for the Air Pollution Prevention Law of the People's Republic of China" and other relevant regulations.
Article 2 The laundry and dyeing industry referred to in these specifications means the industry engaged in the business services of cleaning, ironing, dyeing, mending clothes, as well as cleaning and maintenance of leather products or fur clothing.
Article 3 These specifications stipulate the basic requirements for the operation and management of the laundry and dyeing industry and apply to laundry and dyeing enterprises, individual industrial and commercial households, and practitioners within the administrative region of this city.
Article 4 The commerce department is the competent authority of the laundry and dyeing industry, responsible for formulating industry development plans, conducting credit evaluations of laundry and dyeing enterprises, and comprehensive coordination work.
According to the "Measures for Arbitration Inspection and Product Quality Appraisal Management (Original National Quality and Technical Supervision Bureau Order No. 4 of 1999)", a laundry responsibility appraisal committee composed of relevant personnel is established to conduct laundry quality appraisal and coordinate the resolution of major disputes arising between operators and consumers regarding service.
Article 5 The city's laundry and dyeing industry association shall strengthen industry self-discipline, actively assist relevant government departments in supervising and managing the operation and service of laundry and dyeing enterprises, and protect the legitimate rights and interests of consumers.
(1) According to the city's laundry and dyeing development plan, guide the reasonable layout and orderly development of the industry, and assist the government in regulating the laundry and dyeing market.
(2) Establish a service purpose of convenience, for the people, and benefiting the people; organize education for operators on compliance with laws and regulations and lawful operation. Advocate professional ethics of dedication, honesty, high-quality service, and convenience for the public within the industry.
(3) Safeguard the legitimate rights and interests of operators and consumers.
(4) Fulfill supervision over industry operating conditions, technical level, processes, environmental protection, water conservation, energy saving, and service personnel identification.
(5) Standardize operation services, publicly display business licenses, professional qualification certificates, service items, price lists, quality standards, complaint phone numbers, etc.
Chapter 2 Conditions for Opening
Article 6 To open a laundry shop, the following provisions must be observed:
1. Apply for registration with the industrial and commercial administrative department and legally obtain a business license.
2. Comply with the city's laundry and dyeing development plan.
3. According to the "Environmental Impact Assessment Law of the People's Republic of China", "Regulations on Environmental Protection of Construction Projects" and other relevant regulations, apply to the environmental protection administrative department for the administrative permit of "Environmental Protection Approval for Construction Projects."
4. According to the "Regulations on Environmental Protection Management of Construction Projects", after the completion of new laundry projects, apply to the environmental protection administrative department for the administrative permit of "Acceptance of Environmental Protection Facilities for Construction Projects." Only after passing acceptance can the project be put into use.
According to the "Beijing Implementation Measures for the Water Law of the People's Republic of China", after the completion of new laundry projects, apply to the water administrative department for the administrative permit of "Acceptance of Supporting Water-saving Facilities for Construction Projects." Only after passing acceptance can the project be put into use.
Dry cleaning shops must obtain water usage quota approval before opening, and pay additional water fees for the rated water usage quota.
Article 7 According to the hardware conditions, regulations, and personnel quality requirements for opening:
1. Laundry shops shall comply with the requirements of SB/T10271—1996, GB4287—92, GB8978—88, and relevant national and municipal regulations.
(1) Comply with the relevant provisions of the municipal environmental protection bureau's "Administrative Permit for Environmental Protection Approval of Construction Projects."
(1) Meet the basic requirements on the construction foundation;
(2) Laundry facilities shall not be located inside residential buildings or above the second floor in mixed-use buildings with residential functions;
(3) Dry cleaning must use environmentally friendly dry cleaning agents. Boilers must use clean energy. Washing and drying machines must use low-noise equipment and meet the noise standards of the functional area where they are located.
(4) Laundry shops must independently install water meters and charge according to meter readings.
(5) Dry cleaning machines must use circulating water.
(2) Dry cleaning shops and dry cleaning machines shall comply with the technical specifications of GB16204—1996 and QB/T2326—1997 (revised).
1. For laundry shop openings, perchloroethylene dry cleaning machines must meet the following conditions:
(1) Dry cleaning control must be equipped with a condensation recovery device to improve solvent recovery rate. The maximum concentration of perchloroethylene in the drum shall not exceed 300 PPM.
(2) Must have safety sealing devices during dry cleaning machine operation, oil-water separators, and anti-backflow devices for water supply and drainage.
(3) Install activated carbon filtration exhaust systems; solvent volatility must not exceed 25-27 PPM. Exhaust emissions must meet national and Beijing atmospheric pollutant discharge standards.
(4) Perchloroethylene residue disposal must comply with national and Beijing regulations on hazardous waste and hazardous chemical disposal.
(5) Must have good ventilation facilities; the exhaust volume above the main machine must reach 0.5 m² per second; the maximum concentration of perchloroethylene in workshop air is 200 mg/m³.
2. Petroleum solvent dry cleaning machines must comply with fire safety standards.
3. Fluorinated solvents must not be used as dry cleaning agents.
(3) Laundry shops must comply with the "Beijing Implementation Measures for the Water Law of the People's Republic of China", "Beijing Implementation Measures for the Water Pollution Prevention and Control Law of the People's Republic of China", GB4287-92, GB8978-88, and other regulations.
1. Must install water reuse treatment devices to meet environmental protection, water saving, and energy saving requirements;
2. Must install water treatment devices; wastewater must not be discharged directly into rivers, lakes, rainwater pipelines, infiltration pits, infiltration wells, etc.; wastewater treated and reused through reclaimed water equipment should be discharged into the urban sewage network as required to facilitate centralized sewage treatment.
3. Wastewater discharge must meet the "Beijing Water Pollutant Discharge Standards".
(4) According to the "Occupational Disease Prevention Law of the People's Republic of China" and its supporting management measures, dry cleaning shops must adopt effective occupational disease protection measures and provide workers with effective personal occupational disease protective equipment. New, rebuilt, or expanded laundry factories must undergo preventive health review by health authorities.
Employers (operators), according to Article 30 of the "Occupational Disease Prevention Law of the People's Republic of China", must truthfully inform workers of possible occupational disease hazards and their consequences, occupational disease protection measures, and benefits when signing labor contracts (including employment contracts) with workers.
Operators must organize occupational health examinations for employees before starting work, during employment, and upon leaving, and truthfully inform employees of the results. Occupational health examinations should be conducted by medical and health institutions approved by the municipal health administrative department. The cost of health examinations for employees shall be borne by the operating enterprise.
2. Have a fixed shop or business premises, with dedicated clothing storage facilities and counters for receiving and delivering clothes.
3. The laundry business premises should prominently display the business license, service items, price list, professional qualification certificates, complaint acceptance units, and telephone numbers.
4. Basic requirements for employees:
1. Employees should uphold professional ethics, be familiar with relevant government laws, decrees, and internal regulations, and comply with the law;
2. Employees must have technical qualification certificates or pass professional department assessments to meet job competency requirements.
Chapter 3: Business Service Management
Article 8: Laundry operators shall not engage in the following behaviors:
(1) Operating without meeting safety, hygiene, environmental protection, energy saving, and water saving requirements;
(2) Failing to clearly display service items and prices, or arbitrarily charging prices;
(3) Using deceptive processing methods and service modes, such as passing "water washing" off as "dry cleaning";
(4) Using counterfeit or substandard equipment and raw materials that do not meet national or industry standards;
(5) Emitting dry cleaning solvent exhaust, producing wastewater, noise, and other pollutants exceeding national or Beijing standards;
(6) Laundry technical workers working without certification;
(7) Other illegal business activities.
Article 9: When receiving laundry, operators should carefully listen to consumers' specific requirements for washing, dyeing, ironing, and weaving clothes, and provide truthful and clear answers to consumers' questions, offering authentic service information.
Article 10: When receiving clothes, operators should carefully inspect the condition of the clothes and fulfill the following responsibilities:
(1) Check whether there are any items or accessories left in pockets, whether decorations are complete, the condition of damage, and the degree of cleanliness.
(2) Inform consumers about easily damaged, easily corroded, and valuable decorations or accessories, clarify custody responsibilities, and note this on the service receipt with consumer approval.
(3) Explain to consumers the age, cleanliness, fabric texture, and degree of performance change (within standard limits) of the clothes and the expected washing (dyeing) effect; clothes can only be accepted after consumer confirmation.
(4) For clothes that are indeed difficult to wash or have stubborn stains that cannot be removed, operators should negotiate with consumers, confirm the washing effect, and note it on the service receipt before providing cleaning.
Article 11: For high-end clothing priced over 2000 yuan, operators may implement insured premium cleaning. Consumers state the price of the clothes, and under mutual agreement, a written insured premium cleaning (dyeing) agreement is made. Consumers pay an insured premium cleaning (dyeing) fee not exceeding 5% of the agreed price. In special cases, the insured premium cleaning (dyeing) fee can also be determined through negotiation between the operator and the consumer.
Article 12: When washing clothes, operators should check the washing labels on the clothes and classify them according to fabric texture, color depth, cleanliness, and stain condition, using the correct washing methods.
Article 13: The following special services should be handled using correct methods according to the type, texture, and structure of the clothes:
(1) Cleaning and maintenance of leather and fur garments;
(2) Ironing clothes;
(3) Dyeing clothes and coating leather products;
(4) Mending clothes should basically follow the mending methods, tools, and materials selected according to the texture, structure, and pattern of different woven and knitted fabrics, with careful finishing after mending.
Article 14: Operators should assign dedicated personnel responsible for inspecting laundry quality, strictly manage the handover procedures of clothes at each process, and prevent loss or damage.
Article 15: Laundry service receipts should be in triplicate, and the agreement becomes effective upon signatures from both the operator's staff and the consumer. The service receipt should include the following: clothing name, brand, quantity, texture, color, damage or missing parts status, service or processing content and method, delivery and pickup dates, storage period, consumer's name, address, contact number, operator's name, address, contact number, and complaint acceptance unit and phone number.
Chapter 4: Quality Requirements
Article 16: Cotton fabrics that have been washed and disinfected must meet the following hygiene standards:
(1) Total bacterial count: <200 cfu/25cm2;
(2) Coliform bacteria: must not be detected/50cm2;
(3) Pathogenic bacteria: must not be detected/50cm2;
Article 17: Clothing washing and dyeing shall meet the washing and dyeing quality standards or comply with the requirements agreed upon in advance with the consumer.
Article 18: Different textured clothes washed with water (except as agreed) shall be washed thoroughly, cleaned, undamaged, without color transfer or color mixing; no traces left after stain removal; rinsed clothes shall be clean, tidy, soft, and odorless.
Article 19: Different textured clothes dry cleaned (except as agreed) shall be washed thoroughly, cleaned, undamaged, without color transfer or color mixing; no traces left after stain removal; clothes shall maintain original color and shape; buttons, linings, and other accessories or decorations shall not lose button rings or deform.
Article 20: After cleaning and maintenance of leather products and fur clothing (except as agreed), they shall not deform, the leather shall be soft, color uniform, color fast, fur soft and elastic, clean and odorless.
Article 21: Ironed clothing shall be flat, crisp, not deformed, no missed ironing, no dead creases, no iron marks, with clear, neat, and beautiful lines, and the ironing effect shall be durable.
Article 22: Dyed clothes shall ensure the texture is not damaged, guarantee color fastness, no fading or streaking, and the color shall meet the requirements agreed upon in advance with the consumer.
Leather products shall have even coloring, sizing, and spraying, consistent color, good fastness, undamaged leather, lining without color mixing, and a neat appearance.
Article 23: The mended parts of clothes shall be consistent with the original clothes in texture, color, warp and weft organization, density, and pattern changes; for complex patterned clothes, the textile, density, and pattern changes shall be roughly the same. After mending, the surface shall be flat, without residual threads or raised fibers, firm, and with a good appearance.
Chapter 5 Compensation Principles
Article 24: If due to the operator's responsibility, the washed and dyed clothes fail to meet the washing and dyeing quality requirements or do not comply with the requirements agreed upon in advance with the consumer, or cause damage or loss of clothes, the operator shall provide reprocessing, refund the washing and dyeing fee, or compensate for the loss according to different situations.
Article 25: Clothing valued over 2000 yuan may implement insured premium cleaning; if damage or loss is caused by the operator's responsibility, or if professional technical appraisal shows failure to meet washing and dyeing quality standards directly affecting the original quality of the clothes and cannot be restored, the operator shall fully compensate according to the price agreed with the consumer at the time of receipt.
Article 26: For non-insured service clothes, if damage or loss is caused by the operator's responsibility, compensation shall be made based on the purchase time and price indicated on the purchase certificate. The annual depreciation rate is 20% (less than one year counted as one year), increasing yearly, with a maximum depreciation rate not exceeding 70%. Compensation for purchases within three months shall be 95% of the purchase price; within six months, 90% of the purchase price.
If the purchase certificate cannot be shown, compensation can be estimated based on the brand recorded on the receipt and market price with depreciation. If the brand, specifications, or condition are not indicated, compensation shall not exceed 20 times the washing fee. The compensated clothes belong to the operator; if the consumer requests them, the compensation can be reduced by 30%.
Article 27: If a single piece of a suit is damaged or lost due to the operator's responsibility, only single-piece compensation is made, with a 6:4 ratio for jacket and pants; if the entire suit is damaged or lost, compensation is made by the suit; specific methods follow Article 26 of this standard.
Article 28: If accessories or decorations on clothes are damaged or lost due to the operator's responsibility and do not affect normal wear, only single-item configuration or compensation is made; if normal wear is affected, compensation is made according to Article 26 of this standard.
Article 29: When washing clothes according to the washing labels on the clothes, the operator shall carefully check and identify them. If the washing labels are inaccurate, the consumer shall be informed and the correct washing method adopted. If the consumer insists on washing according to the label and due to misleading labels the washing and dyeing quality standards are not met or do not comply with the agreed requirements, the operator may not be held responsible.
Article 30: If a quality inspection agency certifies that the clothing production and quality do not meet relevant national standards, and after normal washing and dyeing processing the clothes show fading, shrinking, bubbling, deformation, etc., the operator may not be held responsible. If no certification is provided, the operator shall bear the quality responsibility.
Article 31: If consumers and operators have compensation disputes, they may resolve them according to the provisions of the "Consumer Rights Protection Law of the People's Republic of China."
Chapter 6 Safety Management
Article 32: Equipment and facilities must comply with safety regulations:
(1) Machinery, electrical appliances, and pressure vessels must pass safety tests by relevant departments and meet safety requirements.
(2) Newly installed laundry equipment must have factory inspection certificates; special equipment and measuring instruments for laundry must be inspected and approved by technical supervision departments before use. Operating laundry equipment must be re-inspected by technical supervision departments; those failing inspection must be stopped immediately.
(3) Dry cleaning equipment must be equipped with alarm devices; if the equipment operates abnormally, the dry cleaning machine can automatically alarm and power off.
Article 33: Laundry shops using petroleum as dry cleaning solvent must have strict fire prevention measures and regulations.
Article 34: Equipment operators must receive professional and formal safety training and hold certificates; unlicensed personnel are strictly prohibited from operating equipment.
Article 35: Each laundry shop (company) must, according to relevant regulations, equip safety management personnel to ensure safety.
(1) Must have full-time or part-time safety officers trained professionally in safety.
(2) Must have full-time (or part-time) occupational health professionals responsible for occupational disease prevention according to the "Occupational Disease Prevention Law of the People's Republic of China," establishing and improving workplace occupational hazard detection and evaluation systems, occupational health archives, labor health monitoring archives, and emergency plans for occupational hazard accidents.
(3) For work positions with serious occupational disease hazards, warning signs and Chinese warning instructions shall be set in prominent locations. The warning instructions shall specify the types and consequences of occupational hazards, prevention, and emergency treatment measures.
Chapter 7 Supervision and Management
Article 36 The departments of commerce, industry and commerce, quality supervision, environmental protection, water affairs, health, production safety supervision and management, urban management, and others shall strengthen the supervision and management of the laundry and dyeing industry. Violations of this "Specification" shall be investigated and dealt with according to their respective authorities and in accordance with the law.
Chapter 8 Supplementary Provisions
Article 37 This specification shall be interpreted by the Beijing Municipal Bureau of Commerce.
Article 38 The model text of the laundry and dyeing contract involved shall be formulated by the Beijing Municipal Administration for Industry and Commerce, Beijing Municipal Bureau of Commerce, and Beijing Laundry and Dyeing Industry Association.
Article 39 This specification shall come into effect on October 1, 2004.
