Article 1 To regulate the business conduct of the laundry and dyeing industry, promote the healthy and orderly development of the laundry and dyeing industry, protect the legitimate rights and interests of consumers, and fairly and justly resolve disputes related to laundry and dyeing services, these measures are formulated in accordance with the "Consumer Rights Protection Law of the People's Republic of China" (hereinafter referred to as the "Consumer Law") and relevant laws and regulations, combined with the actual situation of this city.
Article 2 All laundry and dyeing service operators (including enterprises) engaged in the laundry and dyeing industry within the administrative region of this city shall comply with these measures.
Article 3 The laundry and dyeing industry referred to in these measures means the service industry that provides washing, ironing, dyeing, mending for clothes made of cotton, linen, silk, wool, and chemical fibers, as well as cleaning, coloring, and decorating services for leather clothing.
Article 4 Units and individuals engaged in laundry and dyeing business shall register with the industrial and commercial administrative department and obtain a business license before operating.
Article 5 Laundry and dyeing service operators shall hang their business license in a prominent place at the business premises and clearly indicate the delivery time and business hours in accordance with laws and regulations.
Laundry and dyeing services must implement clear pricing. The "Tianjin City Laundry and Dyeing Industry Price List" shall be hung in a conspicuous place at the charging site. The content includes: service items, service content, grade, service price, etc. The price list is uniformly supervised by the Tianjin Municipal Price Bureau. No fees other than those listed may be charged, and no false or misleading pricing content or methods shall be used to commit price fraud.
Article 6 Laundry and dyeing service operators shall ensure service quality. Enterprises engaged in washing, ironing, dyeing, mending, and coloring of fur clothing shall have specialized equipment and professional personnel that meet the relevant national standards.
Article 7 The grading of laundry and dyeing service operators shall be voluntarily declared by the operators themselves, reviewed and evaluated by the industry association according to the "Tianjin City Laundry and Dyeing Enterprise Grading Standards," and approved and recognized by the competent authority.
Article 8 Laundry and dyeing service operators shall not engage in the following violations:
(1) Operating beyond the business scope or operating washing, ironing, dyeing, mending, etc., without a license;
(2) Passing off "water washing" as "dry cleaning";
(3) Using counterfeit or inferior dry cleaning equipment to provide laundry and dyeing services;
(4) Violating Article 8 and other provisions of the Consumer Law.
Article 9 Before providing laundry and dyeing services to consumers, operators shall provide consumers with true and effective service information and give truthful and clear answers to consumers' questions or inquiries.
Article 10 When providing washing services, laundry and dyeing service operators shall follow these procedures:
(1) Listen to consumers' requirements for washing, ironing, dyeing, mending, etc., analyze and confirm the fabric properties of the clothes, and clearly inform consumers if the clothes, such as blood-stained items, are harmful to others' health and unsuitable for washing or cannot be serviced;
(2) When receiving clothes, check whether there are non-washable items left in the pockets and whether accessories are complete; clearly indicate any damages, burns, snags, moth holes, stains, and other defects on the clothes to the consumer; explain the washing effect on decorations and patterns; after consumer confirmation, sign and note on the receipt before accepting the clothes.
(3) Washing methods shall be determined according to the washing labels on the accepted clothes; if there is no washing label, inform the consumer, negotiate the washing method, and make a note.
(4) After washing, dyeing, ironing, and mending, the clothes shall meet the "Tianjin City Laundry and Dyeing Industry Service Quality Standards" or the service quality requirements agreed with the consumer, be neatly folded, and delivered on time;
(5) When handing over clothes to consumers, the clerk shall collect the clothes receipt, verify it against the actual items, and only after consumer confirmation and no dispute shall the receipt be taken back and the clothes delivered to the consumer.
Article 11 For clothes requiring value-preserving fine washing, both parties shall make a value-preserving fine washing agreement on the principle of equality and voluntariness, charge the value-preserving fine washing fee according to the agreed price for the clothes, and the fee shall not exceed 5% of the agreed price.
Article 12 Receiving clothes shall be done with a uniformly printed credit card and triplicate receipt.
Article 13 If laundry and dyeing service operators damage or lose clothes that require value-preserving fine washing, they shall compensate according to the price agreed with the consumer in advance.
Article 14 Article For clothes that are not value-preserving washed, if damaged or lost, compensation shall be made based on the purchase receipt's depreciated value; if no purchase receipt is available, compensation shall be based on the market average price of the clothes, with an annual depreciation rate of 25% according to the "Tianjin City Laundry and Dyeing Industry Service Quality Standards," and cumulative depreciation not exceeding 70%. After compensation, the clothes belong to the laundry and dyeing service operator, or the actual value of the clothes at the time of delivery shall be negotiated with the consumer for resolution.
If clothes are damaged due to incorrect washing labels (or quality disputes arise), the responsible party shall be liable or negotiate a solution with the laundry and dyeing service operator.
Article 15 When receiving clothes, laundry and dyeing service operators shall remind consumers to remove easily damaged or corroded decorations or accessories from the clothes. If damage occurs due to the consumer's removal, the consumer shall bear the responsibility.
Article 16 If the service quality of laundry and dyeing service operators does not meet the standards specified in the "Tianjin City Laundry and Dyeing Industry Service Quality Standards" or the standards agreed with the consumer, free re-washing shall be provided; if the re-washing still does not meet the specified or agreed standards, all fees paid by the consumer shall be refunded. If the consumer and operator have other agreements, those shall prevail.
Article 17 If the operator delays delivery beyond the agreed period by more than three days, a compensation of 1 yuan per garment per day shall be paid to the consumer; if the consumer delays pickup beyond the agreed period by more than three days, a storage fee of 1 yuan per garment per day shall be charged. If the consumer and the operator have other agreements, those shall prevail.
Article 18 If a dispute arises between the laundry operator and the consumer over the quality of laundry services and the disputed item needs to be appraised, the appraisal fee shall be advanced by the laundry operator, with the consumer providing an equivalent guarantee. If the appraisal confirms that the service quality does not meet the standard regulations or the mutually agreed standards, the operator shall bear the appraisal fee; if the appraisal confirms that the service quality meets the standard regulations or the mutually agreed standards, the consumer shall bear the appraisal fee.
Article 19 Disputes over laundry services between consumers and laundry service operators involving technical issues can be consulted with the Laundry Industry Association or relevant professional departments, and resolved according to the following legal channels:
(1) Negotiate and settle with the laundry service operator;
(2) Request mediation from the Consumer Association;
(3) File a complaint with the relevant administrative department;
(4) Submit to arbitration according to the arbitration agreement reached with the laundry service operator;
(5) File a lawsuit in the People's Court.
Article 20 If laws and regulations provide other methods for resolving consumer disputes in the laundry service industry, those provisions shall apply.
Article 21 These measures shall come into effect on March 15, 2003.
