The "Notice" points out that China consumes a large number of plastic shopping bags every year. While plastic shopping bags provide convenience to consumers, due to excessive use and inadequate recycling and disposal, they also cause serious waste of energy and resources as well as environmental pollution. Especially ultra-thin plastic shopping bags are prone to damage and are mostly discarded casually, becoming a major source of "white pollution."
The "Notice" proposes that the General Administration of Quality Supervision, Inspection and Quarantine should accelerate the revision of national standards for plastic shopping bags, establish prominent qualified product marks for plastic shopping bags, research and promote quick and simple testing methods for plastic shopping bags, urge enterprises to strictly produce according to national standards, and ensure the quality of plastic shopping bags. The "Notice" also requires quality inspection departments to establish a product quality supervision mechanism for plastic shopping bag manufacturers. For those who continue to produce ultra-thin plastic shopping bags in violation, or fail to affix (print) the qualified product mark as required, or engage in other illegal acts, penalties such as orders to stop production, confiscation of illegally produced products, confiscation of illegal gains, and fines will be imposed in accordance with the "Product Quality Law of the People's Republic of China" and other laws and regulations. Quality supervision measures should be improved, law enforcement efforts increased, and systems for exposure, recall, rectification, and punishment strictly implemented.
The "Notice" also puts forward specific requirements for other related government departments regarding the restriction on the production, sale, and use of plastic shopping bags. For example, the National Development and Reform Commission should promptly revise the "Catalogue for Guiding Industrial Structure Adjustment" to include ultra-thin plastic shopping bags in the list of products to be eliminated; the Administration for Industry and Commerce should strengthen supervision and inspection of the sale and use of plastic shopping bags in supermarkets, shopping malls, farmers' markets, and other retail locations, and investigate and deal with violations such as continuing to sell or use ultra-thin plastic shopping bags in accordance with the "Product Quality Law of the People's Republic of China" and other laws and regulations; sanitation departments should accelerate the promotion of classified collection and treatment of household waste to effectively reduce the amount of waste plastic mixed into incineration or landfill; environmental protection departments should strengthen environmental supervision over the recycling and utilization of waste plastics, formulate environmental access conditions, pollution control standards, and technical specifications and supervise their implementation, and establish a whole-process environmental management system for waste plastics from recycling, transportation, storage to reuse; science and technology departments should increase support for research and development of waste plastic treatment and disposal technologies, develop and promote technologies and products that improve the added value of waste plastic utilization, and improve the level of waste plastic resource utilization; finance and taxation departments should promptly study and formulate tax policies to suppress waste plastic pollution, use tax leverage to regulate the production, sale, and use of plastic shopping bags, and support and encourage the development of the comprehensive utilization industry of waste plastics.
The "Notice" points out that the State Council will earnestly implement the law enforcement responsibility accountability system and strengthen the responsibilities of local people's governments at all levels and relevant departments of the State Council. For administrative inaction and weak law enforcement, the main responsible persons and related personnel of the relevant competent departments and law enforcement agencies will be held accountable in accordance with the "Administrative Licensing Law of the People's Republic of China" and the "Administrative Punishment Law of the People's Republic of China."
